ICSAS was formed to offer to Trade Associations and commercial users of contracts, an alternative means of settling disputes other than by having to resort to law.
The service is not prescriptive as to any specific commercial or trade sector, product or product range (e.g. agriculture) to which it may be applied, and it is not designed to replace, or impose upon, any of the established trade arbitral schemes. It is designed for, and intended for use by, any organisation or body which does not have an arbitration scheme. It is suitable for UK and international commodity or maritime transactions.
The ICSAS arbitration rules are based on English law, with awards which conform to the requirements of the Arbitration Act 1996. The juridical seat will be in England irrespective of the domicile or country of operation of the parties.
The scheme provides for either single tier arbitration settlement, or for an Appeal procedure.
ICSAS holds separately the names of arbitrators approved for appointment to determine commodity and maritime disputes under
ICSAS rules. These selected arbitrators are experienced and variously professionally proven in commodities of whatever nature, and in the maritime sector.
The inclusion of an arbitration clause in a contract ensures that the parties are bound to take any mutually irresolvable disputes to arbitration for settlement.
ICSAS can offer the wording of a clause which covers this requirement, for insertion into contracts.
In aiming to offer a higher than average quality arbitration award the scheme provides for the scrutiny by the
ICSAS lawyer prior to issuance of awards, to ensure total accuracy of fact and law, and the assurance of the prompt availability to the parties of an award on completion of the consideration by a sole arbitrator or by a tribunal, thus eliminating lengthy and potentially damaging delays which are pervading some other institutional schemes.
ICSAS offers an arbitration administration service to Trade Associations who may wish to divest themselves of that role while continuing to maintain an arbitration service for their members involving that Associations approved arbitrators.
